Jamie Foxx Slams 2nd Sexual Assault Lawsuit By Same Accuser
Jamie Foxx speaks up and makes his stance known on a second sexual assault lawsuit brought by the same accuser.
The actor requested that the fresh refiled case be dismissed as he claims the event did not happen without the accuser's consent.
The undisclosed plaintiff claimed she met Jamie Foxx in 2015 at an event where he got forcefully sexual with her and only stopped when her friend came to the scene.
Jamie Foxx Claimed No One Was Forced To Do Anything
The 56-year-old claimed that while things got hot and heavy with the accuser, it did not happen outside her consent. "To the extent [Jamie] engaged in any conduct as alleged in [Doe's] [lawsuit], [Doe] consented to those acts," Foxx's lawyer asserted.
The attorney continued that "to the extent [Jamie] engaged in any conduct as alleged" in the lawsuit, "such conduct presented no serious risk of physical injury to [Doe]."
The actor added that the woman had already filed a nearly identical lawsuit in 2020, which In Touch reported that the court dismissed.
He explained that if the plaintiff suffered any injury, it was not his doing and added that the accuser "waived the right to pursue her claims by reason of her own actions and course of conduct."
The Accuser Described Her Meeting With Foxx
The plaintiff claimed Foxx was intoxicated when they met at Catch NYC & Roof in August 2015, where her friend asked if the actor would take a picture with her.
She stated that Foxx complimented her "supermodel body" and claimed she smelt good. They then proceeded to a private area of the club's rooftop, where the actor allegedly groped her and put his hand beneath her dress.
Foxx then allegedly grabbed her breasts and stuck her finger into her vagina and anus, but he could not go on further because her friend came around the corner.
She demanded compensation in unspecified damages for the pain, suffering, and emotional distress caused by Foxx's acts on that night.
The Plaintiff Pleaded To Remain Anonymous
The accuser also declared her desire for her identity to stay hidden due to the sensitivity of the case.
She noted that she suffered "psychological and emotional injuries" due to the assault" and her fair share of "significant shock, shame, and embarrassment" for her disclosure due to Foxx's famous status.
"This case has already been on every major news outlet and has caused me to fear for my safety given the fame of Defendant," she added that it was tough for her to come forward and narrate her ordeal.
She claimed that the assault caused "depression, anxiety, lack of sleep, and distress," and a public disclosure would only add to her emotional trauma.
The alleged victim wrapped up her declaration by emphasizing her unwillingness to go public and thus "bear the stigma that is associated with being a sexual assault victim."
Inside The Previously Filled Lawsuit
In 2023, The Blast reported the first sexual assault lawsuit filed by the same accuser at the same location and in the same year (2015).
In the first lawsuit, she claimed the intoxicated actor told her she looked like Gabrielle Union and pulled her by the arm to the back area of the venue.
Like the details in the second lawsuit, she claimed the actor put his hands beneath her top. She, however, tried to stop the act and walk away, but she felt helpless when a security guard and other passersby who saw them refused to intervene.
In the 2023 lawsuit, the woman sued Foxx, the event venue, and its employees for compensatory and punitive damages. She explained that she had to undergo medical treatment due to the injuries she sustained during the encounter with the singer.
The Lawsuit Comes After Jamie Foxx's Hospitalization
The sexual assault lawsuit was filed months after Foxx survived the darkest moment of his life that left him hospitalized for weeks. The Blast reported that the 56-year-old explained he had a "bad headache" on April 11, 2023, and requested Advil to reduce the pain.
The next thing he remembered was opening his eyes 20 days later without a single memory of what had happened prior. He disclosed that his family told him he was in Atlanta and that his sister and daughter took him to the first doctor.
The actor added that he decided not to say much about the incident because he wants his fans to see him as the happy Foxx they have always known.
"I just didn't want you to see me with tubes running out of me and trying to figure out if I was going to make it through," explained the "Django Unchained" actor. He also debunked claims of losing his motor skills due to the issue and declared that he was on his way back to full recovery.
Will this latest lawsuit carry water, or will it also be dismissed? Only time will tell.
