California kindergartner can use cannabis drug in school, judge rules
A kindergartner can now bring a cannabis-based drug to her public school in Northern California, like in a bad Adam Sandler comedy. But for 5-year-old Brooke Adams, it’s a godsend. The drug is an emergency treatment for a rare form of epilepsy and helps her function like an average kindergartner.
On Saturday, a judge ruled in favor of Brooke Adams being able to bring a cannabis-based drug, which she uses in an emergency, to the Rincon Valley Union School District in Santa Rosa, Calif., according to the Santa Rosa Press-Democrat.
The Rincon Valley Union School District in Santa Rosa was attempting to ban the drug from school grounds, arguing that its use violated federal law. While all marijuana use is illegal under federal law, children’s medical marijuana use with a doctor’s recommendation is legal in California.
A nurse accompanies Adams to school and applies the oil three times during the school day to treat the seizure condition.
According to Fox News, Judge Charles Marson made the order permanent on Friday.
“I was so overwhelmed with emotion and joy that we don’t have to fight anymore after a battle of over two years,” Jana Adams, the girl’s mother, told the Associated Press. “She can just go to school like any other child, and we don’t have to keep pushing to get what she needs.”
Joe Rogoway, the Adams family lawyer, hopes the ruling will allows other students who need cannabis-based drugs on campus to have more freedom to use them.
While district officials are still reviewing the decision, Assistant Superintendent Cathy Myhers said she welcomes the legal guidance. “We are pleased with the decision and guidance,” Myhers said. “We are happy to have a decision that supports our ability to educate and serve this student in our public schools.”
